This Policy is legally binding between Inovacity and the end user (“You,” “Your,” or “Yourself”).

Personally identifiable data assists Our customer identity verification teams to monitor, moderate and mitigate potential fraud risks, illegal activities or prohibited conduct. Select data may also be used to comply with jurisdictional laws, cooperate with public, government or law enforcement agencies during investigations, aid authorized audits, protect Our legitimate legal rights or manage exigencies under licensing statutes to operate within the Federal Republic of Nigeria.

  5. DATA PROCESSING AND RETENTION
  6. controls and advanced security tools as permissible under technology constraints to safeguard availability, confidentiality and integrity of all User data during processing, retention and transmission stages in consonance with applicable data protection and cybersecurity laws. Access to sensitive data is only provided to authorized personnel on Need-to-know basis under confidential bindings. Retention timeframe warranted for each category of personal data under processing activities is predetermined in accordance to Our internal retention policies congruent with statutory norms. Post expiry, information is either permanently deleted or anonymized for archival purposes with linkage to identity removed.

  7. DATA TRANSFERS AND DISCLOSURES

  9. GOVERNING LAWS

All data protection, handling, privacy or associated processing activities in relation to personal user data by Inovacity including Our employees, service vendors, partners and other associated participants is comprehensively governed under the statutory provisions of the Nigeria Data Protection Act 2023 (NDPA) as administered by the National Information Technology Development Agency (NITDA) under powers conferred through the NITDA Act 2021 and subject to the regulatory oversight jurisdiction of Federal Ministry of Communication and Digital Economy concerning permissions, breach reporting and compliance enforcement. Furthermore, any emerging disputes, claims, proceedings or causes of action initiated by affected users against Inovacity under theory of contract, tort or otherwise regarding alleged non-compliance, misconduct, negligence or liability attributable to misinterpretation or breach of clauses outlined under this Privacy Policy shall be exclusively and mandatorily referred for mediation or binding arbitration to Lagos Multi Door Courthouse (LMDC) under supervision of Lagos State Judiciary benches if resolution remains unattainable through good faith mutual negotiations or amicable settlement between both parties.

  11. MODIFICATIONS TO PRIVACY POLICY

We reserve the sole discretionary right to modify, amend or replace sections of this Privacy Policy attributable to periodic revisions instituted internally in Our data usage practices, collection modalities, processing workflows, regulatory changes or technological upgrades without advance notification requirement. Such changes are instantly made effective for all existing and new users upon upload of the latest version displayed on Inovacity’s official website for improved public access. Users carry the responsibility to periodically examine the current master Privacy Policy prevalently applicable to their membership for updated practices.

  13. OPT-OUT PREFERENCES
  14. We respect user choices and privacy preferences. Any user who wishes to opt-out of non-essential communications, reporting illegal activities or withdrawing consent granted can submit such requests by emailing support@inovacity.net. Our compliance teams shall address the queries on priority and initiate processes permissible under constraints to honor choices that align with Our policy limitations.
